Legal terms and conditions for using our services

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and TastiHusba Coffee Machine Service ("TastiHusba," "we," "us," or "our") regarding your use of our website and coffee machine services.

By accessing our website, booking our services, or engaging with us in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our website or services.

2. Description of Services

TastiHusba provides professional coffee machine maintenance and repair services across Canada, including but not limited to:

  • Professional descaling services
  • Filter replacement and installation
  • Comprehensive maintenance and inspection
  • Emergency repair services
  • Consultation and technical support
  • Preventive maintenance programs

We reserve the right to modify, suspend, or discontinue any service at any time without prior notice, subject to applicable law.

3. Service Booking and Scheduling

3.1 Booking Process

  • Service requests must be submitted through our website, phone, or email
  • All bookings are subject to technician availability and confirmation
  • We will provide estimated service windows, not guaranteed appointment times
  • Customer must provide accurate contact information and service location details

3.2 Scheduling Changes

  • Customers may reschedule appointments with at least 24 hours notice
  • TastiHusba reserves the right to reschedule due to emergency calls or unforeseen circumstances
  • We will provide reasonable advance notice for any schedule changes

3.3 Cancellation Policy

  • Customers may cancel appointments without penalty with 24 hours advance notice
  • Cancellations with less than 24 hours notice may be subject to a cancellation fee
  • No-show appointments will be charged a service call fee

4. Pricing and Payment

4.1 Service Pricing

  • Prices are quoted in Canadian dollars (CAD) and include applicable taxes
  • Service estimates are provided based on initial assessment; actual costs may vary
  • Additional charges may apply for parts, materials, or extended service requirements
  • Emergency service calls may be subject to premium pricing

4.2 Payment Terms

  • Payment is due upon completion of service unless otherwise arranged
  • We accept cash, credit cards, and electronic transfers
  • Invoices for commercial accounts are due within 30 days
  • Late payment charges may apply to overdue accounts

4.3 Disputes and Refunds

  • Service disputes must be reported within 7 days of service completion
  • Refunds are considered on a case-by-case basis for unsatisfactory service
  • Diagnostic fees are non-refundable regardless of repair decisions

5. Customer Responsibilities

5.1 Access and Preparation

  • Provide safe and reasonable access to equipment requiring service
  • Ensure adequate workspace and electrical power availability
  • Remove personal items and clear work area before technician arrival
  • Provide accurate description of equipment issues and service history

5.2 Equipment Condition

  • Inform us of any known safety hazards or equipment modifications
  • Disclose any previous repair attempts or damage
  • Provide equipment manuals and warranty information when available

5.3 Safety and Compliance

  • Ensure compliance with local building codes and electrical requirements
  • Maintain safe working conditions for our technicians
  • Follow all post-service instructions and recommendations

6. Warranties and Guarantees

6.1 Service Warranty

  • We provide a 90-day warranty on all service work performed
  • Warranty covers defects in workmanship, not normal wear and tear
  • Warranty is void if equipment is serviced by others during warranty period
  • Customer must provide proof of service for warranty claims

6.2 Parts and Components

  • Replacement parts are covered by manufacturer warranties when applicable
  • We guarantee proper installation of all parts and components
  • Defective parts will be replaced at no charge during warranty period

6.3 Warranty Limitations

Our warranty does not cover:

  • Damage caused by misuse, abuse, or negligence
  • Normal wear and tear or consumable items
  • Damage from power surges, water, or environmental factors
  • Modifications or repairs performed by unauthorized personnel
  • Equipment beyond economical repair

7. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability for any claim shall not exceed the amount paid for the specific service
  • We are not liable for indirect, consequential, or punitive damages
  • We are not responsible for loss of business, profits, or data
  • Claims must be brought within one year of the service date
  • Our liability is limited to repair or replacement of defective service

Some jurisdictions do not allow limitation of liability, so these limitations may not apply in all circumstances.

8. Intellectual Property

All content on our website, including text, graphics, logos, and software, is owned by TastiHusba or our licensors and is protected by intellectual property laws. You may not:

  • Reproduce, distribute, or modify our content without permission
  • Use our trademarks or service marks without authorization
  • Reverse engineer or copy our service methodologies
  • Create derivative works based on our materials

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our data practices as described in the Privacy Policy.

10. Force Majeure

We shall not be liable for any delay or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:

  • Third-party claims related to your use of our services

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict of law principles.

12.2 Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through:

  1. Direct Negotiation: Good faith discussions between the parties
  2. Mediation: Non-binding mediation if negotiation fails
  3. Arbitration: Binding arbitration under Ontario arbitration rules
  4. Court Proceedings: Ontario courts as a last resort

12.3 Jurisdiction

Any court proceedings shall be conducted in Toronto, Ontario, and you consent to the jurisdiction of Ontario courts.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. We will provide notice of material changes through:

  • Email notification to registered customers
  • Prominent notice on our website
  • Updates to the "Last updated" date

Your continued use of our services after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Invalid provisions shall be replaced with valid provisions that most closely reflect the original intent.

15. Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and TastiHusba. These Terms supersede all prior negotiations, representations, or agreements relating to the subject matter.
